nao acho hilario, acho triste
e'  um problema de setores da industria que tem muita dificuldade em se
reinventar e perdem receita por conta da pirataria, e mesmo em conjunto com
novos negocios que condizem mais com o mundo atual, como netflix, itunes,
etc, ainda tem praticas de negocio que nao conseguem fazer diferente hoje
do que era na decada de 70, 80, quando foram criadas
a columbia por exemplo e produtora e estudio, qual modelo de negocio ela
pode usar pra ser competitiva hoje em dia? mesmo distribuindo o que produz
pra netflix e afins na mesma proporcao que distribuem pra telecine, hbo,
cinema e etc... o modelo e defasado e nao existem alternativas criadas, ou
seja a pirataria afeta eles diretamente
outro ponto e que
o ato juridico dmca apesar de nao ser novo (1996) passou a ter
jurisprudencia mais uniforme nos ultimos 10 anos, dai o subito
desaparecimento de sites de torrent e outras fontes de pirataria em solo
americano entao o que a columbia esta fazendo e sony e outras tantas fazem
tem seu valor juridico que prepara o caminho para uma acao mais seria em
caso de reincidencia ou ma vontade do sistema autonomo de internet em
tentar coibir ou responder a isso
claro que eles estao fazendo por rumo pois aqui em terra tupiniquim o dmca
nao vale muita coisa (pra nao dizer q nao vale nada) e e inutil em linhas
gerais, e se bobear, dependendo da interpretacao do texto do marco civil o
isp/tele nao deveria sequer, saber o que seu usuario esta trafegando, se e
piraria ou nao, que dira se preocupar em coibir. alias o proprio marco
civil isenta o provedor dessa responsabilidade em oposicao ao dmca, o que
faz o dmca nao ter sentido no brasil ainda que algum tratado internacional
sugira que respeitaremos leis estrangeiras em ausencia de equivalentes
nacionais

por ultimo, nao e legal sugerir numa lista com essa amplitude e portanto
grande potencial de influencia, que esse tipo de ato possa ser simplesmente
ignorado se se tornar recorrente, em especial se algo equivalente vier em
bom portugues e o alvo de pirataria nao for algo da grande industria, e sim
de um artista, banda, enfim pessoas, individuos detentores do direito
autoral
isso porque a lei de direito autoral no brasil e bastante severa, antiga, e
portanto bastante discutida e julgada. some a isso o lindo direito de
regresso, tao comum no direito processoal quando se fala de prejuizo
causado a pessoa fisica (o detentor do direito autoral na hipotese

qualquer advogado mesmo que pouco experiente tem grandes chances de
sucesso, focando linha de atuacao com base no direito de regresso, no
direito autoral, e no art 37 p. 6 da constituicao, se de fato o fendido
quiser, pode tentar identificar o causador do prejuizo -- aquele que em
casa deixa seu torrent upando a obra de direito reservado -- e ao
identificar o regresso vai garantir que voce, ISP ou Tele ou qualquer outro
sistema autonomo que foi notificado e nao fez nada, seja tambem considerado
"solidariamente responsavel" e respondera como tal, em ambos "caso de dolo
ou culpa"
os trechos citados vem direto da constituicao entao ainda que o marco civil
isente o provedor da responsabilidade, a constituicao da esse direito de
regresso contra terceiros, ou seja o marco civil como nao altera a
constituicao nao salva o provedor nesse caso
e ai o resto voces sabem, o cod civil garante que se o provedor nao tiver
dinheiro rsss os bens dos administradores e socios serao agredidos em favor
do reparo do dano causado... "por dolo ou culpa"
e se o advogado da parte ofendida quiser brincar no cod civil, a
notificacao seguida de nenhuma acao por parte do provedor ainda pode se
enquadrar em omissao e negligencia; mais um ilicito civil na jogada que
nesse caso nem precisa de regresso, e' omissao/negligencia de fato do
provedor, que foi diretamente notificado
enfim na duvida procure uma acao respaldada juridicamente por alguem ou
algum escritorio de sua confianca, que nao seja alheio ao marco civil

como gestor o que eu faria, no minimo, se for possivel identificar quem
esta naquele IP na data/hora do evento, encaminharia a notificacao ao
cliente, acrescido de texto que deixa claro que a observacao do trafego e
identificacao do IP de origem foi de exclusiva pratica de quem gerou a
notificacao original, nao tendo sido validada ou comprovada por voce
(provedor), garantindo que voce nao faz o que o marco civil diz que voce
nao pode fazer, e acrescentaria algo na linha do "se voce nao praticou esse
ato de pirataria, nao sabe quem pode ter praticado, ou acredita haver algum
engano nessa identificacao, ignore essa notificacao encaminhada", mas claro
isso 'e apenas uma sugestao, e em caso especifico do ofendido pela
pirataria ser uma pessoa

nesse caso da brisanet mesmo sendo uma empresa brasileira, e em
representacao dos interesses da columbia pictures, pode ser sim melhor
ignorar e nao envolver seu cliente pra nao causar problema de
relacionamento, porque nao sao comuns casos de uma empresa conseguir
responsabilizar terceiros por direito de regresso em caso de prejuizo
causado a essa empresa (pj) por uma pessoa (pf)
o comum e ao contrario, a pf conseguir regresso contra todas as pj
envolvidas
